SALARY, REMUNERATION AND CHRISTMAS BONUS IN BRAZILIAN LABOR LAW

This study examines the legal institutes of salary, remuneration and Christmas bonus in Brazilian labor law, with emphasis on their concepts, legal grounds, practical distinctions and juridical effects. It is a theoretical study of a bibliographical and documentary nature, based on the analysis of the Federal Constitution, the Consolidation of Labor Laws, the specific legislation on the thirteenth salary and contemporary labor doctrine. The objective is to demonstrate that salary and remuneration are not synonymous, although they are closely related, and to show that the correct identification of salary and remuneration items has relevant effects on the calculation of vacations, thirteenth salary, severance fund deposits and other labor credits. The findings indicate that salary corresponds to the consideration paid directly by the employer, whereas remuneration has a broader meaning and includes other amounts received as a result of the employment contract, including tips. It is concluded that the technical understanding of these institutes is essential for worker protection, for legal certainty in employment relations and for the proper application of labor legislation.
