THE DISMISSAL OF INITIAL PETITIONS: AN ANALYSIS OF CAUSES IN THE CASE LAW OF THE MINAS GERAIS COURT OF JUSTICE

This study addresses the initial petition and its requirements, the procedural instrument that initiates the pleading stage in civil procedure by prompting judicial action. The objective is to analyze and describe the essential requirements of an initial petition in order to highlight the precautions that must be taken in its drafting to avoid premature terminations and dismissals without a judgment on the merits. Furthermore, the study sought to transform the theoretical and jurisprudential analysis into an educational tool to enhance the skills of law students and legal professionals, thereby enabling greater effectiveness in seeking judicial relief. Documentary research and a bibliographic review were conducted, employing a descriptive and expository approach to the initial petition and its constituent elements, with the development guided by a theoretical review. The results revealed that, in addition to flaws in the drafting of initial petitions, some judicial bodies improperly dismiss them. The initial petition, despite being a subject of study in law courses and a common instrument in judicial practice, is still not fully mastered by legal practitioners, as petitions are frequently incomplete, not accepted, or, when dismissed, are done so improperly. This scenario revealed gaps in the understanding of the fundamental technical aspects of the initial petition on the part of both lawyers and judges.
