EMPLOYMENT CONTRACT: ELEMENTS, CHANGES, PROTECTION AND TERMINATION

Abstract

This study analyzes the employment contract in Brazilian Labor Law, with emphasis on its formation, its constitutive elements, the hypotheses of change, suspension and interruption, the protection mechanisms of the employment relationship, the formalities of worker admission, working time control and the forms of termination of employment. It is a theoretical study developed through bibliographical review and normative analysis, based on the Federal Constitution, the Consolidation of Labor Laws and the Civil Code, as well as doctrinal references and technical texts used in the development of the theme. The study aims to systematize the main aspects of the employment contract, allowing the understanding of its legal structure and its effects throughout the employment relationship. The results show that the employment contract is not limited to the hiring moment, but governs the entire bond between employee and employer, from admission to termination. It is concluded that the employment contract is a central legal instrument for organizing the employment relationship, ensuring predictability, legal certainty and worker protection during the employment relationship and at the moment of its termination.
