GOVERNANCE AND ECONOMIC EFFICIENCY IN PUBLIC PROCUREMENT: AN ANALYSIS OF THE IMPACT OF THE NEW PUBLIC PROCUREMENT LAW IN BRAZIL AND ITS CONTRIBUTION TO FISCAL SUSTAINABILITY

This research deeply analyzes the impacts of Law No. 14.133/2021, the New Public Procurement and Administrative Contracts Law, on governance, economic efficiency, and fiscal sustainability of public procurement in Brazil. Critically reviewing the weaknesses of the previous legislation (Law No. 8.666/1993) through the lens of Transaction Cost Economics and Agency Theory, the study investigates how the new norm, by integrating principles of governance, integrity, strategic planning, and risk management, qualifies public decisions and optimizes resource allocation. Employing a qualitative and applied methodology, with detailed Bardin's (2016) content analysis and data triangulation from multifaceted case studies (Curitiba, HU/UFPE, TCE-MG), documentary analysis of control bodies (TCU, CGU), and recent academic productions, the research demonstrates efficiency gains (reduction of addenda, procedural celerity) and strengthened preventive control. However, persistent challenges such as institutional heterogeneity, information asymmetry, and the need for continuous training are discussed in light of international literature (OECD, World Bank). The article concludes that Law No. 14.133/2021 represents a crucial normative advancement for the modernization of the Brazilian State, whose full success depends on institutional engagement, overcoming cultural barriers, and the strategic articulation between planning, technological innovation (AI, Blockchain), and control for the delivery of public value and the promotion of long-term fiscal sustainability.
