CIVIL LIABILITY FOR PARENTAL ALIENATION: NA ANALYSIS OF THE FEASIBILITY OF COMPENSATION FOR MORAL DAMAGES IN THE DISTRICT OF RIO BRANCO-AC

Abstract

This article aims to analyze parental alienation from the perspective of the civil liability of the alienating parent, with the general objective of verifying the possibility of compensation for moral damages arising from this practice in the District of Rio Branco, Acre. The methodology adopted consists of qualitative research, based on bibliographic review, doctrinal analysis, and examination of case law, especially decisions issued by the Judiciary of the State of Acre. The results show that parental alienation, in addition to violating the fundamental rights of children and adolescents, also constitutes an unlawful act capable of generating civil liability, with the duty to compensate for moral damages being recognized in certain cases involving both the alienated parent and the child. It is concluded that compensation has not only a reparative function but also a preventive and educational role, contributing to curbing abusive practices, protecting family bonds, and ensuring the best interests of the child and adolescent.
