COGNITIVE BIAS AND DECISION MAKING IN LAW: HOW NEUROSCIENCE CAN HELP LAW OPERATORS IN THE DECISION-MAKING PROCESS

The scope of this work is to analyze the extent to which Neuroscience can be used as an instrument for mitigating cognitive biases in the context of legal decision-making. The research seeks to understand the mechanisms through which such biases influence the actions of judges, lawyers, members of the Public Ministry and other legal agents, affecting the rationality and impartiality of the decision-making process. The methodology adopted involves bibliographic and documentary analysis, with an interdisciplinary focus between Neuroscience, Cognitive Psychology and Legal Theory. The results indicate that, although it is not possible to completely eliminate the influence of cognitive biases, it is feasible to reduce their impact through strategies derived from Neuroscience and Modern Cognitive Psychology, promoting more consistent, ethical decisions and committed to a fairer application of the legal order.
