DIGITAL ASSETS, INHERITANCE AND PRIVATE RELATIONS: PERSONALITY RIGHTS IN THE INFORMATION AGE

Abstract

This article examines the legal discipline of digital assets in light of personality rights, with particular focus on succession and civil-constitutional protection. The research, based on a qualitative bibliographic review, adopts the deductive method, moving from the general concept of intangible assets to the specificities of digital inheritance. The functional classification of digital assets into existential, patrimonial, and dual-use categories is highlighted, as well as the tension between private autonomy, social function, and human dignity. The analysis also considers recent court decisions in Brazil and abroad, such as the creation of the figure of the digital executor by the Brazilian Superior Court of Justice (STJ) in 2025. It concludes that although legislation has advanced by recognizing digital assets, there remains a need for legal protection that ensures the primacy of identity and memory over a purely patrimonial logic.
