CIVIL PROCEDURAL JURISDICTION: FROM THE FORMATION TILL THE EXTINCTION

Abstract

This study investigates the fundamental concepts of civil procedural law. The research details the distinction between substantive and procedural law, the notions of jurisdiction and its characteristics (inertia, impartiality, substitutability, and finality), the criteria for establishing jurisdiction (absolute and relative), and the identifying elements of the action (parties, cause of action, and request). The objective is to analyze the fundamental institutes of the process, examining their concepts in light of the Code of Civil Procedure and contemporary doctrine, from a descriptive and analytical perspective, using analogies and examples. The methodology used involves a bibliographic review and legislative analysis, both exploratory and descriptive in nature, with information presented qualitatively. It is hoped that this study will contribute to the understanding of basic notions of civil procedure, the results of which will assist students in understanding the procedural system, covering everything from the formation to the termination of the case.
