PRISON OVERCROWDING AS A VIOLATION OF HUMAN RIGHTS IN BRAZIL

Abstract

Prison overcrowding in Brazil is a critical problem that reveals systematic human rights violations, impacting the dignity of people deprived of their liberty. This article aims to analyze the causes and consequences of this overcrowding, as well as discuss the role of the State in guaranteeing the rights of prisoners. The methodology used includes a literature review and document analysis, with data that highlight the precariousness of the prison system, such as the lack of adequate infrastructure, judicial delays, and the excessive application of custodial sentences. The main results indicate that overcrowding not only compromises the resocialization of inmates, but also perpetuates social and racial inequalities. The conclusion highlights the urgent need for structural reforms that guarantee dignified conditions and respect human rights, promoting alternatives to incarceration and the enforcement of fundamental rights provided for in the Federal Constitution and international treaties.
